Terms of Use

1. Acceptance of terms

By using any part of gift.harpd.com, you agree to these terms. If you do not agree, do not use the site. Continued use after a material change to these terms constitutes acceptance of the updated version. The last-updated date above reflects the most recent revision.

2. Description of services

ImgKit provides browser-based image processing tools, a personalized photo gift creation studio (Gift Studio), digital download products, Pro membership access, and related editorial content. Features may change over time as the product evolves.

Some features require account registration or a paid purchase. Features available without payment are provided on an as-is basis and may be modified, limited, or discontinued at any time.

3. Acceptable use

You may use ImgKit tools for lawful personal and commercial image processing subject to the following restrictions. You may not:

• Upload files that contain illegal content, malware, or material that violates any third-party intellectual property right
• Use automated scripts, bots, or crawlers to generate downloads or abuse free-tier limits without prior written permission
• Attempt to reverse-engineer, decompile, or circumvent technical protection measures on any part of ImgKit
• Impersonate another person or entity or misrepresent your affiliation with any organization
• Use ImgKit to generate or distribute content that is deceptive, harassing, or unlawful

Finished gift images generated in Gift Studio are licensed for personal use, sharing with the intended recipient, and printing for personal display. Resale, redistribution, or use in commercial products requires separate written permission.

4. Intellectual property

ImgKit owns or has rights to the design, layout, code, templates, and editorial content on gift.harpd.com. Nothing in these terms transfers ownership of ImgKit intellectual property to you.

You retain ownership of the photos you upload. By uploading a photo to ImgKit, you grant ImgKit a limited, non-exclusive, transient license to process that photo for the purpose of generating a preview or finished download during your session. ImgKit does not claim any ongoing ownership of or rights to your uploaded photos.

Gift templates, overlay designs, and the Gift Studio interface are ImgKit original works. You may not extract, copy, or redistribute them independently of a finished download.

5. Digital products and downloads

Paid digital products, including HD gift image downloads and Pro membership access, are made available electronically immediately after checkout. Because the product is delivered digitally upon purchase, completed transactions are non-refundable except in the circumstances described below.

ImgKit will provide a resolution or replacement in the following situations:

• Checkout completed successfully but access or the download link did not activate
• A download link expired before the file could be retrieved
• A duplicate charge appears for the same order
• The delivered file is corrupt or does not match what was ordered

Contact support@gift.harpd.com with your order confirmation and a description of the issue. Support will respond within one business day.

6. Pro membership

Pro membership (referred to internally as VIP access) provides expanded download limits, access to premium templates, and other benefits described on the pricing page at the time of purchase. Benefit descriptions on the pricing page at the time of your purchase are the binding definition of what is included.

Pro memberships are personal and non-transferable. You may not share login credentials or download links with other users. Violations may result in access suspension without refund.

ImgKit reserves the right to modify the benefits of active memberships with 30 days' notice. If a material benefit is removed and you no longer wish to continue, you may request a prorated refund by contacting support before the end of the notice period.

7. File responsibility

You are responsible for the files you upload and the outputs you download. ImgKit browser-side tools create delivery copies of your images; they are not a backup system. Keep original files before replacing production assets.

ImgKit does not verify the accuracy, fitness for purpose, or technical correctness of converted, compressed, or processed outputs for every possible combination of input file, browser, and use case. Review outputs before using them in production.

8. Disclaimer of warranties

ImgKit is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. ImgKit does not warrant that the service will be uninterrupted, error-free, or free of viruses or harmful components.

9. Limitation of liability

To the maximum extent permitted by applicable law, ImgKit shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the site or services, including loss of data, lost profits, or business interruption, even if ImgKit has been advised of the possibility of such damages.

ImgKit's total liability to you for any claim arising from use of the service shall not exceed the amount paid by you to ImgKit in the 12 months preceding the claim, or $10 USD if no payment was made.

10. Changes to these terms

ImgKit may update these terms as features change or legal requirements evolve. Material changes will be communicated via a notice on the site. The last-updated date at the top of this page always reflects the most recent revision. Continued use after a change constitutes acceptance.

11. Governing law

These terms are governed by and construed in accordance with applicable law. Any disputes arising from these terms or your use of ImgKit that cannot be resolved through support should be submitted to binding arbitration or a court of competent jurisdiction.
